Agreement and scope

These Terms govern your use of Sunny and its associated website and features (the Service), operated by People Make Things, Inc., a Delaware corporation (People Make Things, we, us). By accepting these Terms through the Service, you agree to this contract. If you do not agree, do not use the Service. Our Privacy Policy explains our personal-information practices, including data licensing, advertising-related sharing, privacy choices and the rewards-related financial-incentive notice. Accepting this contract does not replace any separate privacy consent required by law.

1. Eligibility

Sunny is offered only in the United States. You must be at least 18 and legally able to enter this agreement. We ask users to self-report their age during onboarding; users who report being under 18 are not eligible. Provide accurate eligibility information and comply with restrictions applicable in your location. If a feature requires additional verification, you must complete it before participating.

2. Accounts

Use accurate registration information, protect your login credentials and notify us if you suspect unauthorized access. You are responsible for activity you authorize through your account. Third-party sign-in, if offered, is also subject to that provider’s terms. We may take proportionate steps to protect compromised accounts and the Service.

3. Service operation

The Service enables users to evaluate supplied content or model outputs and submit non-audio ratings, comparisons, preference judgments, labels or written feedback. We log in-app clicks and actions for safety and abuse prevention. We use automated contribution-quality and fraud checks, which may result in rejected work, withheld rewards or account suspension, subject to applicable law. Profiles and contributions are not visible to other users or the public. Any displayed ranking, score or reward is subject to the published criteria and applicable law. We do not promise a particular outcome, task volume or level of earnings.

No mode of the Service collects or retains your voice or user audio recordings. Listening to supplied audio, if offered, is not a request to record or upload your own voice. The Service does not accept user-audio uploads or request microphone access. No general appeal process for quality scores is offered unless required by law; statutory privacy appeal rights and any legally required human review remain available.

4. Contributions and permitted data uses

“Contributions” means the non-audio material you submit, including ratings, comparisons, preferences, labels and written feedback. “Contribution Data” includes associated task identifiers, timestamps and other disclosed metadata. Neither term includes recordings of your voice, voiceprints or a right to your vocal identity.

You retain any intellectual-property rights you hold in your Contributions. You grant People Make Things a nonexclusive, worldwide permission to host, reproduce, organize, analyze, adapt and display Contributions as necessary to operate, secure, evaluate and improve the Service. People Make Things may allow its service providers to carry out these activities on its behalf. You must have the rights needed to submit your Contributions.

Subject to required notices, choices and applicable law, you additionally grant People Make Things a worldwide, nonexclusive, transferable and sublicensable license to use Contributions and Contribution Data to create evaluation and training datasets, conduct research, benchmark models, train and improve People Make Things models, and license or sell those datasets to research and commercial AI partners for the same disclosed purposes. This license is royalty-free except for any reward or compensation expressly promised under a separate applicable program. It does not grant permission to collect your audio, clone your voice or create a digital replica of your identity.

People Make Things owns the original software, compilations, annotations and other materials it creates to the extent recognized by law; that ownership does not transfer your underlying rights or extinguish privacy rights. Partners obtain only the rights their agreements lawfully provide.

You may decline training and licensing and continue using Sunny, but future coin earning pauses as described in Section 6. Requests may be sent to team@sunny.site. Consent withdrawal and deletion requests are handled under the Privacy Policy and applicable law. Where consent is required, withdrawing it stops future processing based on that consent, subject to lawful exceptions. Prior lawful processing is not retroactively invalidated. Existing recipient copies and effects on trained systems must be assessed under applicable law and partner obligations; this contract does not make personal-data rights irrevocable merely because data was licensed.

5. Acceptable use

Do not submit material you lack permission to use; violate others’ privacy or intellectual-property rights; provide unlawful, abusive or exploitative content; impersonate another person; manipulate evaluations, rewards or rankings; use undisclosed automated submissions where prohibited; bypass access controls; compromise security; or interfere with other users. Do not upload recordings of yourself or anyone else: the Service has no user-audio collection mode.

Except where applicable law permits otherwise, do not reverse engineer protected software, scrape restricted content or use the Service’s proprietary materials to develop a competing service or train external models without permission. Any rewards feature must not be used to transfer money between users or provide financial services. We may investigate suspected abuse and restrict affected content or accounts proportionately.

6. Rewards and virtual items

Sunny offers coin rewards for eligible non-audio labeling contributions and related data used for AI development and licensing. Coins are redeemable at 1,000 coins = $1 USD through PayPal, Venmo or gift cards, subject to the cash-out minimum shown in the app, between $3 and $5 USD. Participation is voluntary. You may decline training or licensing and continue using Sunny, but future coin earning pauses. You opt in by enabling contributions and may withdraw at any time by disabling contributions, changing the relevant account setting or contacting team@sunny.site. Where the Privacy Policy provides that opting out of data sale or sharing pauses coin earning, you may still continue using Sunny. These choices are subject to applicable law, and nothing in these Terms permits unlawful discrimination for exercising privacy rights. Coins are not a bank account, investment or user-to-user payment instrument. The reward details displayed in the Service explain eligible work, quality criteria, task earning rates, redemption requirements and any applicable fees, deadlines or geographic restrictions.

We may require proportionate identity, tax, sanctions and anti-fraud checks. We may correct errors or withhold disputed rewards for a substantiated eligibility, integrity or legal reason, subject to notice, review rights and applicable law. Users remain responsible for taxes legally owed. No earnings are guaranteed.

7. Service intellectual property

People Make Things and its licensors retain their rights in the Service’s software, design, branding and supplied materials. Subject to these Terms, you receive a limited, revocable, nontransferable permission to use the Service for its intended purposes. No ownership is transferred to you. Your rights in your own Contributions are addressed in Section 4.

8. Ending access

You may stop using the Service and request account deletion by contacting team@sunny.site. We may restrict or end access for material violations, security risks, legal requirements or discontinuation of a feature, subject to applicable notice and consumer protections. We will handle personal information according to the Privacy Policy and applicable law, rather than treating termination as consent to further processing. Applicable reward rules govern outstanding eligible balances. Provisions that reasonably need to continue, such as ownership and accrued obligations, survive termination.

9. Service limitations

To the extent permitted by law, the Service is provided without guarantees of uninterrupted availability, accuracy or fitness for a particular purpose. Model outputs, evaluations and rankings may be incomplete or wrong and should not be treated as professional advice. Nothing in these Terms excludes mandatory warranties or remedies that apply to you.

10. Liability

To the extent legally permitted, People Make Things is not responsible for indirect or consequential loss arising from the Service, and its aggregate liability under these Terms is limited to the greater of US $100 or the fees you paid People Make Things during the preceding twelve months. These limits do not apply to fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, amounts People Make Things has expressly agreed to pay you, or other liability that cannot lawfully be excluded or limited. Local consumer law may provide additional protections.

11. Third-party claims

To the extent permitted by law, you are responsible for reasonable losses and expenses resulting from third-party claims caused by your unlawful Contributions or material breach of these Terms. This does not make you responsible for People Make Things’s own misconduct. People Make Things must give reasonable notice and cooperation and may not settle a claim in a manner that imposes obligations on you without your consent.

12. Governing law and disputes

These Terms are governed by California law, subject to non-waivable consumer protections. Disputes will be heard in the state or federal courts in San Francisco, California, except where applicable law gives you the right to bring a claim in another court.

Before filing a claim, contact team@sunny.site with a description and the resolution sought so that we can try to resolve it informally. This informal-resolution process does not prevent urgent relief or extend or shorten statutory deadlines. These Terms do not require arbitration or waive class-action or jury-trial rights.

Consumers retain mandatory protections of their place of residence, including available local court access and rights relating to digital services. Where applicable, qualifying automated decisions may be challenged and human review requested.

13. Regional and personal-data safeguards

The licenses and permissions in these Terms are limited by applicable privacy, consumer, intellectual-property and identity-protection laws. No provision waives rights that cannot legally be waived. We may limit features where necessary to comply with local requirements. The Service does not collect user audio or voiceprints. Applicable regional privacy protections continue to apply to non-audio personal information.

14. Changes

We may revise these Terms to reflect Service changes or legal requirements. We will identify the effective date, provide required advance notice of material changes and obtain renewed agreement or consent where required. You may stop using the Service if you do not accept a change. We will not use an update to retroactively eliminate accrued payment rights or mandatory legal protections.

15. Exporting your information

You may request access to or a portable copy of eligible personal information and Contributions by contacting us. We will verify the request proportionately and provide access in an appropriate format where required by law or an expressly offered feature. Legal holds, third-party rights and technical limits will be evaluated under applicable law.

16. General provisions

These Terms and any expressly incorporated feature rules form the agreement for this Service, subject to mandatory law and the role of separate privacy notices and consents. A failure to enforce a term once does not waive it. If a provision is unenforceable, the remaining provisions continue to the extent legally possible.

You may not transfer your contractual access rights without our permission. People Make Things may transfer this agreement in a lawful corporate reorganization or sale, subject to applicable notice, privacy and consumer safeguards. Neither party is responsible for a delay caused by events reasonably beyond its control, except for accrued payment duties and obligations that law does not excuse.

These Terms do not by themselves establish employment, agency or partnership; actual legal status is determined by applicable law and the facts. Comply with applicable export and sanctions laws. Third parties receive no independent enforcement rights unless an applicable provision expressly grants them.
